The firm’s auto accidents practice page has a section titled “Motorcycle and pedestrian collisions.” This page covers claims against private persons and businesses, such as a driver. Claims against a city, a county, or another government agency follow different rules and are outside this page.

Pedestrian crashes

The National Highway Traffic Safety Administration says on its pedestrian safety page that in 2024, 7,080 pedestrians were killed and more than 71,000 pedestrians were injured nationwide. Its Traffic Safety Facts for 2024 report says 76 percent of pedestrian fatalities in 2024 occurred in the dark.

The same report says substantially more pedestrian fatalities occurred in urban areas (84%) than in rural areas (16%) in 2024. The California Office of Traffic Safety says on its score card that pedestrian fatalities decreased approximately 8.8% from 1,213 in 2022 to 1,106 in 2023.

MedlinePlus lists “motor vehicle accidents” among the “common causes of head injuries.”

When a driver is responsible

Under Civil Code section 1714(a), “Everyone is responsible” for an injury caused to another by “want of ordinary care or skill in the management of his or her property or person,” except so far as the injured person has “brought the injury upon” himself or herself.

Collision reports

The Los Angeles Police Department says its Traffic Collision Reports may be released to “authorized persons such as victims.” The page also lists other individuals who may receive a report.

The firm’s article on the steps to take after a serious car accident is also available.

Deadlines

Under Code of Civil Procedure section 335.1, the period is “two years” for an action for injury to, or for the death of, an individual “caused by the wrongful act or neglect of another.”

As a general rule, the two years are counted from the day of the injury. Deadlines can depend on your situation and on who the claim is against. Consult an attorney. For a death, see the firm’s wrongful death page.

How the firm helps

  • Investigation of what happened and who is responsible, built from records.
  • Communication with other parties and insurers so that you are not handling it alone.
  • Representation in the firm’s practice areas of personal injury, catastrophic injury, and wrongful death.

Personal injury matters are handled on a contingency-fee basis, and legal fees are a percentage of any recovery rather than an hourly bill. Costs and expenses may apply. The details are set out in a written engagement agreement before any representation begins. Every case is different, and results depend on the facts of each case.
